The good news is that you`ve already done all the heavy lifting. The confirmation agreement will not ask you for information that you have not yet included on the front page. It is divided into four parts. The Court of Justice does not need to approve a confirmation agreement applicable to consumer debts guaranteed by real estate. This applies to all mortgages on your home or other debts that are guaranteed by your home. In addition, the Court does not approve confirmation agreements between debtors and credit unions. They are filed and are part of the minutes without being heard. You have the right to revoke (revoke) any confirmation at any time prior to receipt of your dismissal or within 60 days of filing the confirmation agreement with the court, depending on what happens later. To revoke a confirmation agreement, you must send the creditor a written notice that you are withdrawing your decision to confirm and revoke the agreement. Send the original letter to the creditor and a copy to the administrator`s office to be part of your file. Conclusion of the Form form Confirmation Agreement All affirmations must be submitted with the official B27 form, the certification sheet. The confirmation agreement (official form B240A) was amended effective December 1, 2009. In order to allow sufficient time for applicants to implement the change of form, the Court of Justice will authorize a transitional period of six months during which the old (1/07) or the new version (12/09) of the confirmation agreement can be filed.
Note: As of April 1, 2010, the new amended form becomes mandatory for the confirmation agreement. All pro-Se affirmation agreements that are not credit unions or real estate are automatically consulted, regardless of whether there has been a presumption of undue severity. If the confirmation agreement applies to real estate and/or a credit union, no further action will be taken. Subdivision (a) the rule is amended so that the company presenting the confirmation agreement with the court also includes the official form 27, the cover bulletin of the confirmation agreement. The form contains the information necessary to enable the court to determine whether the proposed confirmation agreement is considered unreasonable harshness for the debtor within the meaning of Section 524, point m) of the code. #3 After obtaining the validity of the pledge from the agent and if you wish to confirm the debt, you must complete the cover sheet. They are required to submit completed confirmation documents to the Court. The Court does not accept incomplete or inoperable documents.
In addition, the Court will not complete these documents for you or give you advice. Section 4008 is also amended by removing the provisions relating to the date of a confirmation and discharge hearing. As noted above, point 524 m itself requires that hearings be held on unreasonable cases before the discharge is opened. On other issues, including hearings for the approval of unrepresented debtors` confirmation agreements under section 524, (c) c) 6), the rule leaves the Tribunal with the power to establish oral proceedings at a time appropriate to the particular circumstances of the case and in accordance with the parties` planning requirements. Part B is where you sign the confirmation agreement. Just sign and the date indicated. Second, if your answers to BOTH`s questions were Part II A and Part II B read “Yes” and the box “You think this confirmation agreement is in your financial interest and you can afford to make payments on confirmed debts” also check the first page that says, “No presumption of undue hardship.”
